Acceptance of Terms
The Buyer accepts these Terms either in writing or through conduct. Specifically, the Buyer is considered to accept these Terms by accepting delivery of goods from Labarts or by placing an order with Labarts (whether written, online, by email, or verbally, including by telephone).

Pricing and Description of Goods
Prices quoted or published by Labarts are in Canadian dollars, excluding GST and PST, and may change without notice. Product descriptions are indicative only and items may be substituted with an equal or superior product. Published dimensions are approximate. Rewards and bonus offers are limited to one per customer within the specified validation period.

Handling Fees
For orders under $100 before tax, the Buyer must pay Labarts' current shipping fee. Additional surcharges apply to orders containing dangerous or bulky goods.

Payment Terms
The Buyer must pay the purchase price on or before delivery. Any agreed trade accounts must be settled within the specified terms. Interest of 3% per month (calculated daily) will be charged on overdue amounts. Buyers without pre-arranged payment terms must complete and sign a credit card authorization form for orders over $500 before goods can be charged or shipped.

Returns, Replacements, and Credits
Returns must be authorized by Labarts and accompanied by a Return Stock Authority (RSA) form, valid for 30 days. Returns for credit are only accepted within 7 days of purchase. To obtain a Goods Returned Number, provide the purchase date and original invoice number. Returns must be prepaid and include the RSA Form, with a 20% restocking fee applicable. Goods must be unused and in original condition. Incorrectly supplied goods returned at Labarts' expense will be handled by Labarts' chosen carrier. Specially ordered or custom-manufactured goods are non-returnable.

Claims
Claims for supply shortages or delivery discrepancies must be reported to Labarts within seven days of delivery. Claims for replacement are void if Labarts cannot inspect the goods on request, if the goods were supplied without faults, or if there is evidence of post-supply damage due to misuse.

Security
All goods remain the property of Labarts until all debts owed by the Buyer are fully paid. The Buyer grants Labarts a charge over current and future tangible personal property to secure all obligations. Labarts retains the right to seize and dispose of goods on the Buyer’s default.

Buyer’s Liability
The Buyer is responsible for all goods in their possession and must maintain them in their received condition. This liability persists even in cases of bankruptcy, liquidation, or receivership, with the Buyer’s Directors (if applicable) personally liable for unpaid accounts.

Debt Collection Fees
The Buyer is responsible for any debt collection fees incurred for outstanding and overdue debts.

Personal Property Securities Act 2009 (PPSA)
(Registration) Labarts may refuse to supply goods until the Buyer provides all necessary details for registering a financing statement or change statement under the PPSA.
(Application of Payments) Payments may be applied by Labarts to any outstanding obligation, in any manner deemed fit, and may be amended or reapplied.
(Exclusions) Certain PPSA sections are excluded, and the Buyer waives the right to notice regarding registration events related to commercial property.

Severability
If any clause or part of a clause is deemed illegal, unenforceable, or invalid, it will be removed without affecting the remaining Terms and Conditions.

Legal Email Disclaimer

Next Day Dispatch
The 'Next Day Dispatch Guarantee' applies only to items marked with the 'Express Man' symbol and orders placed before 12pm PST, within Labarts' standard working hours (8am to 5pm, Monday to Friday), excluding weekends and public holidays. The guarantee does not apply to orders under review or in cases of unforeseen events such as power outages or natural disasters.

Labarts Marketing Material
The www.labarts.ca website and related materials including labarts trademark are owned by Canadian Scientific Solutions Inc. Unauthorized reproduction, copying, or use of any site elements or images is prohibited. Legal action will be taken for violations.
